What happens if I refuse a breath test?
The handling police officer will attempt to get a “blood search warrant” from a magistrate judge to retrieve your blood without your consent. However, this usually lengthens the period of time in which the sample is retrieved. Thus, your BAC might be lower due to the passage of time. The refusal will lead you to have your driver’s license suspended until your Administrative License Revocation hearing.
What if I blew above a .15 on the breathalyzer?
BLOOD/BREATH ALCOHOL CONCENTRATION: if a BAC is .15 or more at the time the analysis was performed, the offense is Class A Misdemeanor.
